The Medical Products means the following Licensee-labeled non-laser functioning catheters and guidewires for Licensees laser therapy system that are specifically designed and labeled for use solely with laser angioplasty catheters (I) BIAS sheath, (ii) support catheters, (iii) cardiac lead locking device, and (iv) chronic total occlusion steerwires.  Medical Products does not include catheters for (I) infusion of diagnostic, therapeutic, or embolic agents in the neurovascular region, or (ii) insertion of therapeutic embolic devices in the neurovascular region. Medical Products does not include catheters used to deliver stents of any type.

Field of Use
Licensee designs, manufactures, markets and distributes single-use medical devices used in minimally invasive surgical procedures within the vascular system in conjunction with our proprietary excimer laser system.

A 0.007” guide wire which is placed inside the 0.014” guide wire (patent pending).

4.
The 0.007” guide wire has a tip curvature and is movable inside of the 0.014” guide wire (patent pending).

5.
The removable handle contains a mechanism that allows physicians to change the tip curvature, adjusting the wire stiffness from floppy to stiff, extending the 0.007” wire from the distal tip, and producing impact tapings from the tip of the wire to the calcified arteries (patent pending).

Products shall mean Type 1 Products and/or Type 2 Products.  Type 1 Product shall mean a product embodying the Invention that is a stand-alone guide wire or a combination product that comprised the Invention and any other product that is not a Type 2 Product.  Type 2 Product shall mean a Product comprised of the Invention and Licensee’s TipCat Technology and/or any other technology with respect to which Licensee, its Affiliates or Licenses are required to pay and actually pay royalties to a third party (Third Party Payments).

Intellectual Property shall mean any discoveries, inventions (whether patentable or not), materials, information, data, designs, formulae, ideas, methods, models, assays, research plans, procedures, designs for experiments and tests and results of experimentation and testing (including results of research or development) processes (including manufacturing processes, specifications and techniques), laboratory records, analytical and quality control data, trial data, case report forms, data analyses, reports or summaries and information contained in submissions to, and information from regulatory authorities.

Invention shall mean an innovative device to support interventional cardiologists in crossing, inter alia, chronic total occlusion (CTO) during the wiring step of percutaneous coronary intervention (PCI) procedures as generally described.  A guide wire placed inside a larger guide wire, where the smaller guide wire has a tip curvature and is movable inside of the larger guide wire. The handle contains a mechanism that allows physicians to change the tip curvature, adjusting the wire stiffness from floppy to stiff, extending the smaller wire from the distal tip, and producing impact tapings from the tip of the wire to the calcified arteries.

For clarity, any ClotTriever product that is not covered by any of clause (a), (b) or (c) above is not a Licensed Product.

Field of Use
Intellectual property relates to the braiding technologies underlying its patent in the defined field of use for the treatment of embolism and thrombosis in human vasculature other than carotid arteries, coronary vasculature and cerebral vasculature.

Field of Use means (a) with respect to ClotTriever, the non-surgical removal of soft thrombi and emboli from blood vessels in the peripheral vasculature and/or injection, infusion, and/or aspiration of contrast media and other fluids into or from a blood vessel, and (b) otherwise, the treatment of embolism and thrombosis in human vasculature other than carotid arteries, coronary vasculature and cerebral vasculature (but, for clarity, excluding treatment of any state or condition (other than of embolism or thrombosis) in any and all blood vessels by occlusion or embolization).
