CSL Behring AG was in the news because of a lawsuit filed against it by the University of Massachusetts Biologic Laboratories (MassBio) and Third Sector New England, Inc. (TSNE). The suit was initially filed early in 2016 (in the Commonwealth of Massachusetts) and seeks to clarify and enforce a contract between CSL and the two plaintiffs. The contract at dispute is over the FDA-approved drug CytoGam®. The Biotech giant is accused of not paying royalties on the sales of CytoGam® as per an earlier contract.

CSL Behring is organized under the laws of Switzerland and operates one of the world’s largest plasma-collection networks, CSL Plasma. The parent company appears to be CSL Limited that trades on the Australian Stock Exchange and is headquartered in Melbourne, Australia. However, corporate and operational headquarters are listed as located in Pennsylvania. For the 2014/2015 fiscal year, CSL Behring had REDACTED in sales with 41% from Immunoglobulin products. Cytogam® is one of 10 immunoglobulin drugs sold.
The University of Massachusetts Biologic Laboratories, aka Mass Biologics, is a quasi-state agency now associated with the U of Mass Medical School (UMMS). MassBiologics is the only non-profit, FDA-licensed manufacturer of vaccines in the United States. The Blood and Blood Products program was mostly developed in the 1960’s and ‘70’s. In 1997, the State Legislature transferred oversight of MassBiologics from the Massachusetts Department of Public Health to UMMS. In 2000, the UMMS Board of Trustees authorized MassBio to enter into agreements with private companies and manufacture products that can be sold and marketed outside of Massachusetts.
Third Sector New England is a nonprofit organization providing management and leadership resources to help other nonprofits support healthy communities. It acts as fiscal sponsor, convener, consultant and grant-maker with a service area throughout New England and the U.S.
